These terms and conditions (the "Terms and Conditions") govern the use of https://sensorybalancespace.ca (the "Site"). This Site is owned and operated by Queer Alchemy & Cheryl Folland Guidance. This Site is an ecommerce website.

By using this Site, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.

All content published and made available on our Site is the property of Queer Alchemy, Cheryl Folland Guidance, Cheryl Lien and the Site's creators. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Site.

Sensory Balance Space Inc., The VIP Hub and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Except where prohibited by law, by using this Site you indemnify and hold harmless Sensory Balance Space Inc., Cheryl Lien, The VIP Hub and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of the Province of British Columbia, Canada.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site. We will notify users by email of changes to these Terms and Conditions or post a notice on our Site.

Refunds

Sensory Balance Space Inc. does not offer refunds on products and services rendered in part or in full beyond the scope of individual contracts and agreements.

Disputes

In the event that calm and respectful discourse cannot resolve a dispute, all parties agree not to sue but rather pursue third party impartial mediation and/arbitration at their own expense in lieu of legal action and agree to abide by the decision of said mediation and arbitration.

All parties will be responsible for their own costs associated with the dispute resolution process except in the case of vexatious complaints without merit.

A fee at the determination of the mediator or arbitrator will be levied to the full extent of Canadian Law if the claim of dispute is deemed unfounded or without merit.

The data we collect automatically is used for the following purposes:

Optimize offers, website functionality, and streamline communication.

Deter fraudulent activity via AI and bots and ensure all online shared spaces are safe and inclusive for 2SLGBTQIA+ folks and other marginalized communities.

To ensure only legal adults in their country of origin are accessing services with Queer Alchemy & Cheryl Folland Guidance.

Employees

The VIP Hub is the host of Queer Alchemy and uses third party apps (like Stripe payment systems, PayPal, Google Business).

We may share the following user data with third parties:

Links clicked while using site;Products purchased;Unidentifiable demographics; andPersonal data used by those apps not stored in Queer Alchemy Database where a user may already have an account (PayPal).

We may share user data with third parties for the following purposes:

Efficiency in user experience.

Third parties will not be able to access user data beyond what is reasonably necessary to achieve the given purpose.

Other Disclosures

We will not sell or share your data with other third parties, except in the following cases:

If the law requires it;

If it is required for any legal proceeding;

To prove or protect our legal rights; and

To buyers or potential buyers of this company in the event that we seek to sell the company.

If you follow hyperlinks from our Site to another Site, please note that we are not responsible for and have no control over their privacy policies and practices.

How Long We Store Personal Data

User data will be stored for six months from the time of your last activity. After six months of inactivity, you will receive an email sequence asking you to renew or deny consent of data and communications from this Site going forward. All users who neither renew or deny consent via email communication will be marked as inactive in our system.

All inactive user data is deleted permanently after being inactive for 90 days following the automated process.

You will be notified if your data is kept for longer than this period.

How We Protect Your Personal Data

Our host, The VIP HUB, uses the strongest available browser encryption and stores all of their data servers in secure locations. All data is only accessible to Sensory Balance Space Inc. company members.

Data collected will never be sold or shared with any third party other than those outlined in these terms and services for the purpose of user experience and site functionality.

Data will never be shared without user written and signed consent and can be requested and expunged at any time a user deems necessary.

While we take all reasonable precautions to ensure that user data is secure and that users are protected, there always remains the risk of harm. The Internet as a whole can be insecure at times and therefore we are unable to guarantee the security of user data beyond what is reasonably practical.

International Data Transfers

We transfer user personal data to the following countries:

Canada; and

United State of America.

When we transfer user personal data we will protect that data as described in this Privacy Policy and comply with applicable legal requirements for transferring personal data internationally.

If you are located in the United Kingdom or the European Union, we will only transfer your personal data if:
